Please read these Terms carefully. By creating an account or using RealStay India in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
SECTION 01
Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and RealStay India Technologies Pvt. Ltd. ("RealStay India", "we", "us") regarding your use of the RealStay India website, mobile application, and related services (collectively, the "Platform").
If you do not agree to these Terms, you must not use the Platform. Use of the Platform is void where prohibited by law.
SECTION 03
Accounts & Registration
To access most features of the Platform, you must create an account. By registering, you represent that:
- You are at least 18 years of age.
- All information you provide is accurate, current, and complete.
- You will keep your account credentials confidential and not share them with others.
- You are responsible for all activity that occurs under your account.
- You will promptly notify us at support@realstayindia.com if you suspect unauthorised access to your account.
RealStay India reserves the right to refuse registration or suspend accounts at its sole discretion without prior notice.
SECTION 04
PG Owner Obligations
As a PG owner listing on RealStay India, you agree to:
- Provide accurate, truthful, and up-to-date information about your property, including pricing, amenities, photos, and availability.
- Complete the KYC verification process before your listing can be made public.
- Comply with all applicable local, state, and national laws governing PG accommodations, including local municipal regulations and the Model Tenancy Act, 2021.
- Not list properties you do not own or have authorisation to rent out.
- Respond to tenant inquiries within a reasonable timeframe.
- Not engage in discriminatory practices on the basis of religion, caste, gender (except gender-specific PGs), or disability.
- Maintain the accuracy of your listing. Outdated listings showing unavailable rooms are prohibited.
- Not collect any brokerage or additional fees from tenants that are not disclosed in the listing.
Important: Fraudulent listings, fake reviews, or any attempt to mislead tenants will result in immediate, permanent account termination and potential reporting to law enforcement.
SECTION 05
Tenant Obligations
As a tenant using RealStay India, you agree to:
- Use the Platform only for genuine PG accommodation searches.
- Contact PG owners only for legitimate accommodation inquiries.
- Not misuse the platform to harvest contact details of PG owners for unsolicited marketing.
- Conduct your own due diligence before entering into any rental agreement. RealStay India does not verify all listing details independently.
- Not post fake or malicious reviews that do not reflect genuine experiences.
- Report any suspicious listing, fraudulent owner, or safety concern to us immediately at support@realstayindia.com.
SECTION 06
Prohibited Content & Conduct
The following are strictly prohibited on the RealStay India Platform:
- Posting false, misleading, or fraudulent property listings.
- Uploading offensive, obscene, defamatory, or hateful content.
- Attempting to reverse-engineer, scrape, or systematically download data from the Platform.
- Circumventing the Platform to conduct transactions without using RealStay India's services.
- Creating multiple accounts to circumvent a suspension or ban.
- Impersonating any person, company, or entity.
- Uploading malware, viruses, or any malicious code.
- Using the Platform to harass, threaten, or harm other users.
- Posting content that violates any Indian law, including the IT Act, 2000 and IPC.
SECTION 07
KYC & Verification
RealStay India conducts mandatory Know Your Customer (KYC) verification for all PG owners before their listings are approved and made publicly visible.
- KYC verification requires submission of a valid government-issued photo ID (Aadhaar / PAN / Passport).
- KYC documents are reviewed by our admin team within 3–5 business days.
- Submission of forged or altered documents is a criminal offence and will be reported to law enforcement.
- RealStay India reserves the right to reject any listing or account if verification cannot be satisfactorily completed.
- A rejected KYC can be resubmitted with correct documents. Refer to our Refund Policy for payment implications.
SECTION 08
Subscriptions & Payments
RealStay India offers paid subscription plans for PG owners to list and promote their properties on the Platform.
- All plan prices are displayed on the Pricing page and are inclusive of applicable GST.
- Payments are processed securely by Razorpay. RealStay India does not store card details.
- Subscriptions are activated only after successful payment confirmation.
- Listings go live only after KYC verification is approved by the admin, regardless of payment status.
- Subscription benefits (visibility, special pages, etc.) are active only for the duration of the paid period.
- RealStay India reserves the right to modify plan pricing with 30 days' prior notice to existing subscribers.
SECTION 09
Refunds
Please refer to our dedicated Refund Policy page for complete details. In summary:
- If a PG owner's listing is rejected by the admin due to suspicious activity, policy violations, or failed verification, a full refund of the subscription amount is issued within 10 working days.
- Refunds are processed to the original payment method used at checkout.
- No refunds are issued for voluntary cancellations after a listing has been approved and made live.
SECTION 10
Intellectual Property
All content on the RealStay India Platform — including the brand name, logo, design system, software code, written content, and graphics — is the intellectual property of RealStay India Technologies Pvt. Ltd. and is protected under Indian copyright and trademark laws.
- You may not copy, reproduce, modify, or distribute any part of the Platform without our written permission.
- By uploading photos, descriptions, or other content to the Platform, you grant RealStay India a non-exclusive, royalty-free licence to display and use that content on the Platform.
- You retain all ownership rights to the content you upload.
SECTION 11
Limitation of Liability
To the maximum extent permitted by applicable Indian law:
- RealStay India is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform.
- RealStay India is not responsible for disputes between tenants and PG owners regarding rental agreements, deposits, or property conditions.
- RealStay India does not independently verify all listing details and is not liable for inaccuracies in listings.
- RealStay India's total liability to any user for any claim shall not exceed the amount paid by that user to RealStay India in the 3 months prior to the claim.
SECTION 12
Termination
RealStay India reserves the right to suspend or permanently terminate any account — without prior notice — for:
- Violation of these Terms and Conditions.
- Fraudulent, abusive, or illegal conduct on the Platform.
- Submission of false KYC documents or misleading listing information.
- Any activity that harms the Platform, other users, or RealStay India's reputation.
Upon termination, your access to the Platform ceases immediately. Any active subscription at the time of termination for policy violations is non-refundable.
SECTION 13
Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
Before initiating legal proceedings, parties agree to attempt resolution through good-faith negotiations. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
